Welcome to Retaint.

Retaint (“we”, “us”, or “our”) is a CRM and marketing automation platform that enables businesses to understand, analyse, and engage their customers through unified data, real-time insights, and cross-channel communication.

By accessing or using the Retaint platform and services (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform.

Your use of the Platform is also subject to our Privacy Policy and other applicable policies referenced herein.

2. Eligibility and Account Registration

You must have the authority to enter into a binding agreement on behalf of your organisation to use Retaint.

You agree to:

  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account

3. Use of Services

Retaint provides tools for customer analytics, segmentation, and cross-channel engagement, including messaging via email, SMS, push notifications, and third-party platforms.

You agree to use the Platform only for lawful business purposes and in compliance with applicable laws and regulations.

You must not:

  • Send unsolicited, misleading, or unlawful communications
  • Use the Platform for spam, fraud, or harmful activities
  • Interfere with or disrupt the Platform or its users
  • Copy, modify, reverse engineer, or attempt to extract any part of the Platform

4. Customer Data and Responsibilities

You retain ownership of all data uploaded or processed through Retaint (“Customer Data”).

You are solely responsible for:

  • Obtaining all necessary rights, permissions, and user consents
  • Ensuring compliance with applicable data protection and communication laws
  • Maintaining the accuracy and legality of your data

Retaint acts as a data processor and processes Customer Data solely to provide and improve the Services.

You grant Retaint a limited, non-exclusive, worldwide right to process Customer Data for the purpose of operating, maintaining, and improving the Platform. Retaint may use aggregated and anonymised data for analytics, benchmarking, and product development.

5. Messaging and Communication Compliance

If you use Retaint to send communications (including SMS, WhatsApp, email, or push notifications), you agree to:

  • Obtain valid and explicit user consent
  • Honour opt-outs and unsubscribe requests promptly
  • Comply with all applicable messaging, marketing, and privacy laws

Retaint does not control and is not responsible for the content, timing, or legality of communications sent through the Platform.

6. Third-Party Services and Integrations

The Platform may integrate with third-party services.

Your use of such services is governed by their respective terms and policies. Retaint is not responsible for their availability, performance, or practices.

7. Subscription, Fees, and Billing

Access to Retaint may be subject to subscription fees as agreed separately.

You agree to:

  • Pay all applicable fees timely
  • Comply with the billing terms of your selected plan

Unless otherwise stated, fees are non-refundable.

8. Intellectual Property and License

All rights, title, and interest in the Platform, including its software, design, and underlying technology, remain the exclusive property of Retaint.

Subject to these Terms, Retaint grants you a limited, non-exclusive, non-transferable, and non-sublicensable right to access and use the Platform.

You may not copy, distribute, modify, sell, lease, or create derivative works from any part of the Platform without prior written consent.

9. Data Security

Retaint implements reasonable technical and organisational measures to protect Customer Data.

However, no system is completely secure, and you acknowledge that use of the Platform is at your own risk.

10. Service Availability

We strive to provide a reliable and high-performing Platform. However, we do not guarantee uninterrupted or error-free service.

The Platform may be subject to maintenance, updates, or temporary disruptions.

11. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

We do not guarantee that the Platform will meet your requirements, operate without interruption, or be error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Retaint shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or business opportunities arising from your use of the Platform.

13. Indemnification

You agree to indemnify and hold harmless Retaint, its affiliates, and its employees from any claims, damages, or liabilities arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Any communications or data processed through the Platform

14. Termination

We may suspend or terminate your access to the Platform if:

  • You breach these Terms
  • Your use poses a risk to the Platform or other users

You may stop using the Platform at any time.

15. Amendments

We may update these Terms from time to time. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by the laws of India.
